Frequently asked questions
what is the cooling off period?
The cooling-off period gives the purchaser the ability to rescind the contract within 5 business days after exchange. This is beneficial where the exchange has occurred quickly, giving the purchaser the opportunity to make financial arrangements and conduct further inquiries on the property. The cooling-off period can, however, be waived by providing the vendor with a 66W certificate signed by the purchaser’s solicitor.
How long after the exchange will settlement take place?
The ‘settlement period’ is the period between exchange of contract and when the property title is transferred to the purchaser. Settlement can occur on any mutually agreed date, however, 42 days is the most common settlement period in NSW. This period will differ for off-the-plan purchases depending on the property’s stage of development, however, we can advise you on this on a case by case basis.
Joint Tenants or Tenants in Common?
When purchasing a property with another person, there are two types of ownership options, being joint tenants and tenants in common. Choosing the ownership arrangement that best suits you is important as it affects how the property can be dealt with. Joint tenants hold the property in equal shares with a right of survivorship. This means that if one joint tenant dies, their share in the property automatically passes to the other tenant. Alternatively, tenants in common may hold the property in equal or unequal shares and there is no right of survivorship. Therefore. tenants in common can sell their share of the property or give it away in their will.
Mortgages and Caveats
Mortgages and caveats are important tools used to protect your interests. Mortgages are loans in which a property is given as collateral. Caveats, on the other hand, can be placed on a property where you may have a legal interest in that property, but are not registered as the owner.
